These terms and conditions apply between you, the User of this Website (including any sub-domains, unless expressly excluded by their own terms and conditions), and Internet Malt UK Ltd, the owner and operator of this Website. Please read these terms and conditions carefully, as they affect your legal rights. Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of the Website. If you do not agree to be bound by these terms and conditions, you should stop using the Website immediately.

In these terms and conditions, User or Users means any third party that accesses the Website and is not either (i) employed by Internet Malt UK Ltd and acting in the course of their employment or (ii) engaged as a consultant or otherwise providing services to Internet Malt UK Ltd and accessing the Website in connection with the provision of such services.

You must be at least 18 years of age to use this Website. By using the Website and agreeing to these terms and conditions, you represent and warrant that you are at least 18 years of age.

  1. Internet Malt UK Ltd Company Details and Registrations

    1. Internet Malt UK Ltd is a company incorporated in England and Wales with registered number 5496625 whose registered address is 98 High Street, Wavertree, Liverpool, L15 8HQ and it operates the Website www.mindyourfingers.co.uk. The registered VAT number is 865 1699 81. Internet Malt UK Ltd is registered as a data controller at the Information Commisioners Office, registration number Z2816893.

  2. Delivery and Carraige

    1. Operating Days and Times;
      1. We operatate on business days only, between the hours of 9:30am and 5:00pm.
      2. Our partner couriers operate on business days only.
      3. Business days are Monday to Friday, excluding all UK bank holidays.
    2. Processing Orders;
      1. Order placed on a business day before 2pm are normally processed on that day. This is on a best endevour basis. At busy periods orders placed close to the cut off time may not be processed until the following working day.
    3. Carraige Charges;
      1. Free delivery is available for orders over a certain value.
      2. Premium services are available for a fee. You will be made aware of these choices and the fees before completing your order
      3. Some products are exempt from the free delivery option. Including but not limited to fuel and gas products, large or oversize items. You will be made aware of any such items in the product description.
    4. Delivery of Goods;
      1. Goods will be sent to the address provided by you. If the address provided is incorrect you will be responsible for collecting the goods from the address you provided.
      2. Disposal of packing materials is your responsibility.
      3. If items are missing or damaged please report this to us within two working days from the delivery day.
      4. Sometimes, for reasons beyond our control we may be prevented from delivering your goods as planned. These might include accidents, breakdowns, fire, flood, storm, severe weather, acts of god, war, riot, civil commotion, malicious damage or the default of our suppliers/couriers. We are not responsible where this causes a delay or failure in delivering your goods.
      5. Time is not the essence of the contract unless expressly stated otherwise in writing by a Director of the Company.
      6. We are not liable for any loss earnings due to late, incorrect or lost deliveries.
  3. Cancellation and Returns

    1. Scope of Policy;
      1. This policy does not apply to goods ordered by a business.
      2. This policy does not apply to orders for personalised goods where the personalisation has already been applied.
    2. Cancellation of Contract;
      1. You can cancel your contract at any time upto 14 days after the goods have been delivered. (For personalised items you can cancel the contract at any time prior to the personalisation being applied to your item, once the item has been personalised then cancellation is not possible).
      2. To cancel your contract please e-mail, call us or write to us. Note that if you do wish to cancel a personalised item then time will be of essence so call at the earliest oppurtunity.
      3. You do not have to give a reason for cancellation. However, a brief explanation will help us to improve the service we offer to our customers in the future.
    3. Return of Goods;
      1. If you cancel, you must return the goods within 14 days of cancellation, complete with the original packaging to us and/or our supplier (or any other UK address specified by us), at your own expense. You must ensure that the goods are packaged adequately to protect against damage.
      2. You may properly examine the goods for 14 days as you would do had you visited our showroom, however you may not return any goods that have been used unless they are faulty.
      3. You will be responsible for the safe return of goods. For this reason we recommend you use an insured and tracked delivery service.
      4. We are not responsible should any goods you return be lost or damaged in transit back to us.
      5. If you fail to return the goods, we will deem you have decided to keep the goods and no longer wish to cancel the contract.
  4. Faulty Goods / Guarantee

    1. Goods faulty on arrival or within 14 days of arrival;
      1. Contact us via email or phone and we will facilitate a return of the faulty item for direct replacement.
      2. If an item is no longer available or temporarily out of stock we will offer an alternative. However, our liability will be to replace the faulty goods only and we are unable to guarantee an exact match.
    2. Goods which develop a fault after 14 days;
      1. All warranties are Return to Base, this means the customer is responsible for the cost of returning the faulty goods to the manufacturers appointed UK service agent.
      2. If there is a problem with the goods, please notify us by email or in writing providing details of the problem. We will deal with the matter in accordance with your legal rights.
      3. All goods are covered by a manufacturer’s warranty against faulty workmanship and materials, subject to the terms and conditions of that warranty.
      4. The manufacturer’s warranty is provided in addition to the rights that the law says you have as a consumer and accordingly, your statutory rights are not affected.
      5. The standard procedure for warranty claims is for the customer to return the faulty item to the manufacturer for repair or replacement at the manufacturers' descretion.
      6. We will assist you in the process but we are not able to facilitate repairs as we are not the authorised repair agents. You may return goods to us which we will forward on to the manufacturer on your behalf, however, please note this will significantly slow down the process.
      7. Please note that due to postal regulations, some items are classed as restricted goods by Royal Mail, this applies to all used lighter products. You will not be able to use Royal Mail to return such items for repair. An alternative courier service must be used.
  5. Intellectual property and acceptable use

    1. All Content included on the Website, unless uploaded by Users, is the property of Internet Malt UK Ltd, our affiliates or other relevant third parties. In these terms and conditions, Content means any text, graphics, images, audio, video, software, data compilations, page layout, underlying code and software and any other form of information capable of being stored in a computer that appears on or forms part of this Website, including any such content uploaded by Users. By continuing to use the Website you acknowledge that such Content is protected by copyright, trademarks, database rights and other intellectual property rights. Nothing on this site shall be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademark, logo or service mark displayed on the site without the owner's prior written permission
    2. You may, for your own personal, non-commercial use only, do the following:
      1. retrieve, display and view the Content on a computer screen
      2. print one copy of the Content
    3. You must not otherwise reproduce, modify, copy, distribute or use for commercial purposes any Content without the written permission of Internet Malt UK Ltd.

    1. You must ensure that the details provided by you on registration or at any time are correct and complete.
    2. You must inform us immediately of any changes to the information that you provide when registering by updating your personal details to ensure we can communicate with you effectively.
    3. We may suspend or cancel your registration with immediate effect for any reasonable purposes or if you breach these terms and conditions.
    4. You may cancel your registration at any time by informing us in writing to the address at the end of these terms and conditions. If you do so, you must immediately stop using the Website. Cancellation or suspension of your registration does not affect any statutory rights.

Whilst Internet Malt UK Ltd uses reasonable endeavours to ensure that the Website is secure and free of errors, viruses and other malware, we give no warranty or guaranty in that regard and all Users take responsibility for their own security, that of their personal details and their computers.
    3. Internet Malt UK Ltd accepts no liability for any disruption or non-availability of the Website.

    2. We will not be liable to you in respect of any losses arising out of events beyond our reasonable control.

      1. any business losses, such as loss of profits, income, revenue, anticipated savings, business, contracts, goodwill or commercial opportunities;
      2. loss or corruption of any data, database or software;

  11. General

    1. You may not transfer any of your rights under these terms and conditions to any other person. We may transfer our rights under these terms and conditions where we reasonably believe your rights will not be affected.
    2. These terms and conditions may be varied by us from time to time. Such revised terms will apply to the Website from the date of publication. Users should check the terms and conditions regularly to ensure familiarity with the then current version.
    3. These terms and conditions together with the Privacy Policy and Cookies Policy contain the whole agreement between the parties relating to its subject matter and supersede all prior discussions, arrangements or agreements that might have taken place in relation to the terms and conditions.

    7. This Agreement shall be governed by and interpreted according to the law of England and Wales and all disputes arising under the Agreement (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the English and Welsh courts.
